7.  Use of the Site and the material on it

 

You agree that the Site itself, as well as all intellectual property rights in it and content, videos, training materials, products, services, HTML/CSS, Javascript, graphics, voice, and sound recordings, artwork, photos, documents, and all other materials made available on the Site by us or other third parties (collectively referred to as the “Content”) are our property (or licensed to us by third party providers). By continuing to use the Site you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights around the world. All such rights are reserved.

 

Subject to your compliance with these terms of use, we hereby grant you a limited license, on the following terms, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site solely for your personal purposes. You must not use any part of the Content for commercial purposes without obtaining in advance a licence to do so from us or our licensors. Our status (and that of any identified contributors) as the authors of content on the Site must always be acknowledged.

All registered or unregistered trade names, trademarks, and images and biographical information of people used on the Site, including without limitation the name and trademark “Jo Bansall.Art”, are either our property of, or used by us with the permission of the owner. Nothing contained in these terms or on the Site shall be construed as granting, by implication or otherwise, any license or right to use any trademark or other proprietary information without the express written consent of us or the third party owner. 

 

You may not use the Site for any purpose that is unlawful or is prohibited by these terms of use, or to perform or solicit or allow the performance of any illegal activity or any other activity that infringes our rights or those of others, or in any way that causes or may cause damage to the Site or interferes with any other present use or enjoyment of the Site.

 

8. Uploading your content to the Site

 

Whenever you make use of a feature that allows you to upload content to the Site, or to make contact with other users of the Site, such content must not be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or to be in violation any party’s intellectual property rights or these terms of use. You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty. We have the right, to remove content and material that we deem, in our sole discretion, to be in breach of these terms.

Any content you upload to the Site will be considered non-confidential and non-proprietary. 12. User-generated content is not approved by us

 

The Site may include information and materials uploaded by other users of the Site, including to bulletin boards and chat rooms. This information and these materials have not been verified or approved by us. The views expressed by other users on our site do not represent our views or values.

14. Our responsibility for loss or damage suffered by you

• We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

 

• Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any products or services to you, which will be set out in our Course Terms and Conditions.

 

  • We do not warrant or make any representations regarding the use of the Content on the Site, the results of the use of such Content, the suitability of such materials for any user’s needs or the likelihood that their use will meet any user’s expectations. We do not warrant or make any representations or guarantees that you will earn any money using the Site or the any products or services you may obtain from us. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.

 

15. No  responsibility for viruses 

 

We do not guarantee that the Site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access the Site. You should use your own virus protection software.

 

You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this term, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.

18. Governing law and jurisdiction

 

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

 

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
